He went home to see his kids, not to see Kathy. Getting a little action was a bonus which lead to Stabler number five. As far as we know, Elliot and Kathy did everything but talk, if you know what I mean. It seemed more like a moment of two horney people who hadn't gotten any in a while. It also seemed like Kathy just missed him and saw that he was hurting. She wanted to comfort him and Elliot was more then willing to let her. I mean dang, he had those clothes off in marathon time. I hate it when people call that a booty call. A booty call is when a guy/girl calls their special someone to come over and get it on. Elliot asked to see the kids, not have a little fun in the sheets.
I think marianna was referring to Dependent- at the end of the scene, Elliot was at the house wanting to talk to Kathy- not see the kids. He asked her to come outside so they can talk, where he says that he loves his job and his family, he nearly lost both for good and wants to come home. We don't know if Kathy ever submitted the signed divorce papers to her lawyer or even if she did, after that, she could've contacted her lawyer and said to void it as they were trying to work things out.
Ok about the scene in Annihilated...I think hisgirl will post something that would be a better thought however my take of the scene, Elliot had not once taken his eyes away from Kathy while he was undressing, while he walked to the bed and the only time he did take his eyes off of Kathy was to see her hands hold his. Another thing, I do agree that Kathy missed him as I firmly believe that Elliot missed her- I mean geez, he did take off his clothes faster then Superman can change out of Clark Kent! Elliot did call her up to see the kids- she asked if that helped him feel better knowing that his kids were safe, sound, and sleeping peacefully without a bullet hole. Kathleen wasn't in the room when her parents had sex (compromise word between making love and booty call) so she shouldn't be too quick to judge what happened however she did have a point of saying "Come home or don't, there's nothing in between" and I do think Kathleen, in her own way, was looking after her mother, protecting her. We also don't know what happened in the aftermath before he went downstairs to drink orange juice; he could have snuck out when Kathy fell asleep OR they both decided that it would be better if he leaves so that in the following morning, they wouldn't confuse the heck out of the kids when all of the sudden their dad's there- sure it would make them happy but I get the feeling that it would've thrown them off track as well.
